On 13 March 2026, the fifth scholarly monograph by Professor Yueting Liu — and at the same time his first academic work written in German — was officially published by the renowned German academic publisher Nomos Verlagsgesellschaft.

This monograph principally explores the following thesis: the essential characteristic of “legal paternalism” does not lie in protecting individuals from self-inflicted harm, but rather in state intervention into the individual’s right to self-determination and personal autonomy. Legal paternalism constitutes an inevitable consequence of any legal order and cannot be eliminated so long as such a system exists. Consequently, the precise limits of such intervention must be clearly defined. In the context of postmortem organ donation, three dimensions are of particular significance: state paternalism, the protection of legal interests, and the duty of tolerance in situations of necessity. These boundaries simultaneously reveal the inherent limits of legal liberalism. The objective of this study is to propose new theoretical approaches and possible solutions.
